Teilnahmebedingungen:
Ergänzend zu den Nutzungsbedingungen der Plattform „CrowdInnovation RLP“, www.crowdinnovation-rlp.org (nachfolgend „Nutzungsbedingungen“) gelten für das Format „Feedback Call“ folgende Teilnahmebedingungen.
Im Zusammenhang mit der Ermöglichung der auf https://crowdinnovation-rlp.org/ angebotenen Dienste (nachfolgend „Plattform“), wird die Rheinland-Pfälzische Technische Universität Kaiserslautern-Landau (RPTU), nachfolgend „Betreiberin“ genannt.
Im Zusammenhang mit der Veranstaltung des im Rahmen dieser Teilnahmebedingungen durchgeführten Formats „Feedback Call“, wird die RPTU „Veranstalterin“ genannt.
- Veranstalter:
Veranstalterin des Feedback Calls ist die Rheinland-Pfälzische Technische Universität Kaiserslautern-Landau (RPTU), handelnd durch das Referat Transfer, Innovation und Nachhaltigkeit.
- Teilnahmebedingungen
An dem Feedback Call dürfen als Feedback-Geber (Abgabe von Kommentaren und Feedback) alle unbeschränkt geschäftsfähigen natürlichen Personen teilnehmen, die ein aktives Benutzerkonto auf der Plattform www.crowdinnovation-rlp.org eingerichtet haben, zu dem nach den Nutzungsbedingungen zugangsberechtigten Personenkreis gehören und ihren Wohnsitz in der Europäischen Union haben.
Einen Feedback Call einstellen (Feedback Call-Starter) können abweichend hiervon nur Personen, die vom Referat Transfer, Innovation und Nachhaltigkeit insbesondere im Rahmen von Drittmittelprojekten betreut werden (§ 1.6 der Nutzungsbedingungen). Das Einstellen eines Feedback Calls setzt voraus, dass der Feedback Call mit dem Vor- und Nachnamen der einstellenden Person veröffentlicht wird. Die Anzeige des Namens dient der Transparenz und der Nachvollziehbarkeit des Aufrufs gegenüber den Feedback-Gebern. Ohne diese Anzeige ist das Einstellen eines Feedback Calls nicht möglich. Die Betreiberin kann Aufrufe, die sich für einen Feedback Call erfahrungsgemäß nicht eignen, aus sachlichem Grund ablehnen. Ein Anspruch auf Einstellung oder Veröffentlichung besteht nicht (§ 7 der Nutzungsbedingungen).
Der Feedback Call darf ausschließlich dazu genutzt werden, Feedback zu einem Business Case einzuholen. Inhalte, die diesem Zweck nicht dienen, können nach § 6 der Nutzungsbedingungen entfernt werden.
Die Einreichung von Feedback Calls ist ausschließlich in elektronischer Form über die Plattform möglich.
Beiträge werden erst nach Freigabe durch die Betreiberin veröffentlicht (§ 7 der Nutzungsbedingungen).
. Mit dem Einstellen eines Feedback Calls oder der Abgabe von Feedback bestätigt die teilnehmende Person diese Teilnahmebedingungen.
- Durchführung des Feedback Calls
Die Veranstalterin vergibt für den Call keine Geld- oder Sachpreise und stellt solche nicht in .
Sollte eine Person, die einen Feedback Call einstellt (Call-Starter), für ihren Call eine Belohnung ausloben, entscheidet über die Auswahl der begünstigten Person allein der Call-Starter. Eine etwaige Belohnung kommt ausschließlich in der unmittelbaren Beziehung zwischen dem Call-Starter und der ausgewählten Person (Feedback-Geber) zustande. Eine etwaige Vereinbarung und Abwicklung erfolgen außerhalb der Plattform. Die Veranstalterin ist daran nicht beteiligt, wickelt sie nicht ab und übernimmt hierfür keine Gewähr. Die Plattform stellt keine Zahlungsfunktion bereit.
Die Veranstalterin kann einen veröffentlichten Feedback Call innerhalb ihres Netzwerks und ihrer Partnerorganisationen verbreiten, um dessen Reichweite zu erhöhen. Die Nutzungsrechte hierfür richten sich nach § 10 der Nutzungsbedingungen. Die datenschutzrechtlichen Einzelheiten regelt die Datenschutzerklärung.
Der Feedback Call-Starter ist selbst dafür verantwortlich, seine eigene Crowd zu aktivieren. Bei der Ansprache eigener Kontakte hat er zulässige Kommunikationswege einzuhalten, insbesondere keine unerbetene Werbung zu versenden (§ 7 UWG), und die datenschutzrechtlichen Vorgaben eigenverantwortlich zu beachten.
Die Veröffentlichung eingereichter Beiträge und Inhalte richtet sich nach § 7 der Nutzungsbedingungen. Die Nutzungsrechte richten sich nach § 10 der Nutzungsbedingungen. Feedback Calls werden mit dem Vor- und Nachnamen der einstellenden Person veröffentlicht. Kommentare und Feedback werden unter dem Benutzernamen veröffentlicht. Der Vor- und Nachname einer kommentierenden Person wird nur veröffentlicht, wenn diese ausdrücklich eingewilligt hat.
Die Veranstalterin weist darauf hin, dass eine etwaige Belohnung zu versteuern sein kann. Die beteiligten Personen sind dafür allein verantwortlich. Die Veranstalterin ist an derartigen Belohnungen nicht beteiligt.
- Laufzeit des Feedback Calls
Nach dem Start des Feedback Calls können Feedback-Geber in der Regel 28 Tage Kommentare abgeben. Eine Verlängerung der Laufzeit ist durch die Veranstalterin jederzeit . Die Veranstalterin behält sich vor, einen Feedback Call jederzeit abzubrechen.
- Sonstiges
Ein Rechtsanspruch auf Teilnahme, Veröffentlichung oder auf eine Belohnung durch die Veranstalterin besteht nicht.

Terms and Conditions of Participation:
In addition to the Terms of Use for the “CrowdInnovation RLP” platform, www.crowdinnovation-rlp.org (hereinafter “Terms of Use”), the following terms and conditions of participation apply to the “Feedback Call” format.
In connection with the provision of the services offered on https://crowdinnovation-rlp.org/ (hereinafter referred to as the “Platform”), the Rhineland-Palatinate University of Applied Sciences Kaiserslautern-Landau (RPTU) is hereinafter referred to as the “Operator”.
In connection with the organisation of the ‘Feedback Call’ format conducted under these terms and conditions of participation, the RPTU is referred to as the ‘organiser’.
- Organiser:
The organiser of the Feedback Call is the Rhineland-Palatinate University of Applied Sciences Kaiserslautern-Landau (RPTU), acting through the Department of Transfer, Innovation and Sustainability.
- Terms and Conditions
Any natural person with full legal capacity who has set up an active user account on the platform www.crowdinnovation-rlp.org, , who belongs to the group of persons authorised to access the platform in accordance with the Terms of Use , and who is resident in the European Union may participate in the Feedback Call as a feedback provider (submitting comments and feedback).
Notwithstanding the above, only persons who are supported by the Transfer, Innovation and Sustainability Unit, in particular within the framework of third-party funded projects (§ 1.6 of the Terms of Use), may post a Feedback Call (Feedback Call initiators). Posting a Feedback Call requires that the Feedback Call be published with the first name and surname of the person posting it. The display of the name serves to ensure transparency and traceability of the call for feedback vis-à-vis those providing feedback. Without this display, it is not possible to post a Feedback Call. The operator may, on objective grounds, reject calls that, based on experience, are not suitable for a Feedback Call. There is no entitlement to the posting or publication of a Feedback Call (Section 7 of the Terms of Use).
The feedback call may only be used to solicit feedback on a business case. Content that does not serve this purpose may be removed in accordance with Section 6 of the Terms of Use.
Feedback Calls may only be submitted in electronic form via the platform.
Posts will only be published once they have been approved by the operator (Section 7 of the Terms of Use).
. By posting a Feedback Call or submitting feedback, the participant confirms their acceptance of these Terms and Conditions.
- Conduct of the Feedback Call
The organiser does not award any cash or non-cash prizes for the call and does not hold out the prospect of such prizes on .
Should a person posting a feedback call (call starter) offer a reward for their call, the call starter alone shall decide on the selection of the recipient. Any reward shall be arranged exclusively between the call starter and the selected person (feedback provider). Any agreement and settlement shall take place outside the platform. The organiser is not involved in this, does not handle it and accepts no liability in this regard. The platform does not provide a payment function.
The organiser may publicise a published Feedback Call within its network and amongst its partner organisations in order to increase its reach. The rights of use in this regard are governed by Section 10 of the Terms of Use. The details regarding data protection are set out in the Privacy Policy.
The Feedback Call initiator is personally responsible for engaging their own network. When contacting their own contacts, they must adhere to permissible communication channels – in particular, they must not send unsolicited advertising (Section 7 of the Unfair Competition Act) – and must comply with data protection requirements on their own responsibility.
The publication of submitted contributions and content is governed by Section 7 of the Terms of Use. The rights of use are governed by Section 10 of the Terms of Use. Feedback calls are published with the first name and surname of the person who posted them. Comments and feedback are published under the user name. The first name and surname of a person leaving a comment will only be published if they have given their express consent.
The organiser points out that any reward may be subject to tax. The persons involved are solely responsible for this. The organiser is not involved in such rewards.
- Duration of the Feedback Call
Once the feedback call has started, feedback providers can generally submit comments for 28 days. The organiser may extend this period at any time via . The organiser reserves the right to terminate a feedback call at any time.
- Miscellaneous
There is no legal entitlement to participation, publication or a reward from the organiser.
